Long Island Order Protection Attorneys

An order of protection is sought to protect the safety and well-being of an individual threatened with any unacceptable behavior such as physical abuse, violence, stalking, verbal threats, harm, or harassment.  Any person who feels vulnerable to danger, harm, or abuse from a parent, spouse, or relative can file for an order of protection. In the New York Family Court, the person filing for protection is called the “petitioner” and the person whom the charges are brought against is called the “respondent."

Normally, a judge will issue an order of protection upon the petitioner providing an incident of violence, threat, harm, or abuse. A judge may also issue a temporary order of protection until all the details of the case have been heard. Depending on the circumstances of each case, an order of protection is usually granted for one year, unless, special cirumstances exist.

Common Types of Orders of Protection?

A Stay Away Order prohibits the respondent from entering or staying in the same area as the petitioner or the petitioner’s family. Under this order, the respondent is forbidden to come near or enter the petitioner’s workplace, home, or school.

The Refrain-From Order bans the respondent from abusing, threatening, stalking, harming, or harassing the petitioner while still allowing the respondent to be in close proximityto the petitioner.
